`Floor or Ground' Includes Floor of the Car or Vehicle
MATADOR Foam was not too happy that the Central Excise officials were dragging the company all the way to the apex court to unseat a favourable decision of the tribunal on car seats. Matador manufactured "goods made out of vulcanised rubber, other than hardened rubber," and these are "cut to the shape of seats of motor vehicles or two wheelers".
The company classified these under Tariff Heading 40.08, that is, "plates, blocks, sheets, strikes, rods and profile shapes of vulcanised rubber other than hardened rubber of cellular rubber." But the Department wanted the same to be put under 94.01, which read, "Seats (other than those of heading No.40.01), whether or not convertible into beds, and parts thereof."
Notes in Chapter 94 specify that "Pneumatic or water mattresses, pillows or cushions, of Chapter 39, 40 or 63," are not covered, and also that articles (other than parts) referred to in heading Nos. 94.01 to 94.03 are to be classified in those headings "only if they are designed for placing on the floor or ground." Moreover, the following are, however, to be classified in the above-mentioned headings even if they are designed to be hung, to be fixed to the wall or to stand one on the other: a) cupboards, bookcases, other shelved furniture and unit furniture; b) seats and beds.
At the Supreme Court, Mr A. K. Jain, arguing for Matador, said that the goods are cushions, which won't come under 94. But Mr R. Venkataramani, speaking for the Department, submitted that Matador's goods are cut to the shape of seats and are "only used in seats of buses, motor vehicles and/or two wheelers". The court noticed that the goods in question are "cut in the shape of seats and are used only in seats", and so they should fall under 94.01, not 40.08.
Yet, Mr Jain persisted. He said 94.01 would only cover seats "designed for placing on the floor or on the ground or which could be hung or fixed on the wall or designed to stand one on the other". According to Mr Jain, Matador's car seats "are not designed to be placed on the floor or ground and, therefore, they would not be covered under Tariff Heading 94.01".
But Justices S. N. Variava, A. R. Lakshmanan and S. H. Kapadia didn't find Mr Jain's reasoning unacceptable. "The term `floor or ground' would also include floor of the car or vehicle." Seats made for vehicles are placed on the floor of the car or vehicle, said the court. While the verdict should have made the taxman happy, I apprehend if lexicographers are feverishly debating whether to update their definitions of `floor' and `ground'.

The Pillows Success in the U.S

Computer Ergonomics - Pillow Support
THESE DAYS you need not be a software professional to use that dinky little thing called the Personal Computer. Whatever field you are in, you cannot make your day without it. As most of us spend a lot of our time working at the computer workstation, it's worth having a little awareness of its impact on the health and take preventive steps. Proper postures go a long way in preventing all kinds of back/neck pains and eyestrains.
Sitting improperly in front of a computer can cause various injuries, from the short-term discomposure of headache to potentially incapacitating conditions like Carpal Tunnel Syndrome. In this section of ergonomics, let's see what are the proper possible postures that help you keep the twinge at bay.
Let's start with your workstation chair.
# Ensure your seat height is adjusted so that your feet are flat on the floor with your knees equal to or slightly lower than your hips
# Sit with your lower back pushed as far back as it can go in the chair and the shoulders touching the backrest
# Make sure your upper and lower backs are supported with the backrest of your chair reclined to an angle ranging between 90 and 115 degrees. Use inflatable cushions or tiny pillows if necessary
# If your chair has an active back mechanism, use it to make frequent position changes
# Ensure you have removable armrests that allow adjustment of the distance between them
# Keep switching between different postures frequently
Keyboard Fine-Tuning
# Make sure you position the keyboard directly in front of your body and pull up close to the keyboard
# Readjust the keyboard so that its most used section is centred with your body
# Depending upon your sitting position, adjust the tilt using the keyboard feet so that your shoulders are relaxed
# Do not rest your wrists or hands on a palm or wrist rest when you are keying. Do make it a habit to take their support only during breaks from keying
# If you don't have a fully adjustable keyboard tray, try adjusting the height of your chair or use a seat cushion. You can also use a footrest if your feet dangle in air
Monitor Positioning
# Position the monitor so that it's directly in front of you, right above the keyboard in such a way that your neck is in a relaxed position
# Ensure you have the top of the monitor 2-3" above your seated eye level
# Distance yourself at least an arm's length away from the screen
# Ensure you maintain a proper illumination needed for your kind of work
# Place your monitor at right angles with any windows, for, having a window behind you will cause glare and a window in front of you will cause squinting
# You can minimise the glare from overhead lights by using a monitor shield or by adjusting the vertical screen angle and screen controls
# Ensure you place your telephone within easy reach on the side of your non-dominant hand
# Use a headset or speakerphone to avoid neck and shoulder discomfort if you use a phone often all the day
Take Short Breaks
# Once in every 20 minutes, do take a short 1-2 minute stretch breaks. Avoid being in front of the computer in lunch breaks
# Every so often, look away from the computer and focus on something else to avoid eye fatigue
# Have your eyes checked in case of itching/red eye/watering or any other problem and don't forget to inform your eye specialist the number of hours you spend in front of the computer
Laptop Computing
# If you use a side chair or couch while computing, do use a pillow to support your arms while keying. That way, you can have neutral arm, wrist and hand postures
# Use appropriate illumination and angle the screen so that it's at right angles to your line of sight
# Maintain a comfortable viewing distance of about 18-30"
# Try attaching an external mouse instead of using the small-constricted touchpad or trackball
# Keep cleaning the screen regularly using appropriate antistatic cleaning material
Besides the proper posture, ensure you do proper exercises that work for you at the office and at home. Do consult your doctor for the kind of exercises that go with the complete office ergonomics programme.

Bent Up Double? - Lower back pain with sciatica is a common syndrome. Here are the causes and prevention, from the perspective of physiotherapy.
LOWER back pain, like the common cold, is experienced by many individuals. It affects two-thirds of the adult population at some stage or other. Back pain with sciatica is a common pain syndrome. A herniated, slipped, or prolapsed disc causes this syndrome. This article is based on a physical therapy approach. Intervertebral disc prolapse (IVDP) is common in the neck (cervical) and lower back (lumbar) regions. The onset may be sudden or insidious in nature. In the lumbar spine, the most common sites for disc herniation or lesion are the `L3', `L4' and `L4-L5' segments. The lumbar spine is a mobile structure fixed on the sacral spine. Sacral spine mobility is very minimal when compared to the lumbar spine. When there is a mechanical derangement at the lumbar segments, `L4-L5' are more commonly involved due to this region's greater mobility and narrowed posterior longitudinal ligament support. Bio-mechanical studies of the joint prove that when one segment is deranged, hyper mobility in another segment occurs as a compensatory factor. ...
Self-Help Treatment
Robin McKenzie, a physiotherapist and a world renowned spine specialist from New Zealand and founder of McKenzie Institute, devised assessment and treatment approach for the back pain and referred leg pain. He theorises that leg pain shows the severity of disc herniation and the irritation caused by it on the nerve roots emerging from the spine. This type of pain is called peripheral pain. A patient who complains of lower back pain with no leg pain is said to have centralised pain. The basic principle here is that peripheral pain is more intense pinching of the disc on the sensitive neural structures than the centralised pain.
Treatment should be initiated to reduce irritation to the neural structures in spine and thereby alleviate the leg pain. The best way to alleviate leg pain is by lying flat on the stomach (prone lying) for few minutes, until there is no leg pain (see sketch above). Some may feel more comfortable by placing a pillow down the stomach. It may take four to 40 minutes, depending on the severity of the disc impingement on the nerve root in the spine, but the back pain may be persistent. This back pain may resolve faster when you seek a medical professional's help. Physical therapists trained in spinal manipulation, and spinal joint mobilisation can alleviate the back pain within seven to 12 sessions. It is believed that manipulation may work by moving the disc away from pain sensitive tissue. ...
Prevention
The physical therapist may teach the patient stabilisation to strengthen the muscles of the trunk to help prevent a recurrence of the same injury. These exercises can be performed in various positions such as lying on the back, stomach or even lying on a side. Among these exercises, lifting up the opposite arm and leg in a systematic fashion is important to stretch the back muscles. The analogy here is that the spine is a flag pole and the abdominal and back extensor muscles are the flag masts which support the spine.
The physical therapist is the best person to instruct an individual as to when and how these exercises should be performed. Part of the rehabilitation process includes minimising the sitting posture, as this places great pressure on the low back. The patient should try avoiding the use of a motorcycle, scooter, or moped for a few weeks. Two or three-wheelers do not have good shock absorbers and compression of the spine may occur in few minutes when riding these vehicles to work.
When travelling in a bus or train, feel happy when you do not find a seat. Remember that the spine is compressed when sitting down rather than standing. This way, you reach your work place with no pain in the leg and back and have a pleasant day.
