In case of death of a woman in an accident, by burns, by suicide within 7 years of marriage:

if husband and his family is accused by his in-laws, then the man and his family would be arrested without any investigation and they will not get bail for a couple of months (under section 304B of IPC).

The cases generally go on for several years. If they are proven innocent, even then their life gets ruined. If proven guilty, then they get hawa of prison and of course, the long arms of law will try to bring back dead woman to life !!

http://telegraphindia.com/1030924/asp/c ... 394314.asp

So, men should take extreme care when they have somewhat strained relations with their in-laws.

Men can of course take care by taking measures like:

1) Do not take dowry even if your mother insists that this is a social custom and what people will think if you do not take dowry.

2) If you have taken dowry (like many educated people in a state called AP), (you and your wife are living happily ever after), transfer all the money to your wife's name immediately. Do not even be a nominee. You can request your wife to make her mother(or may be her father) as the nominee.

3) Deposit one third of (25%) of your monetary assets at the time of your marriage in the wife's name. or give loans generously to your father-in-law (of course using cheques). That way you can insure yourself a bit.

4) Do not have a kitchen in the house. Get food from outside. Employ a maid servant in the house. That way the wife is also liberated from cooking food and household chores, so that she can watch TV whole day and can fulfill her parent's dream of seeing their daughter happily married.

5) Follow DPS example. Get the whole house wired to voice recorders and hidden cameras. Keep all evidences.

Yeah, DPS is the future....

The Domestic Violence Bill (which is highly biased against men) will passed in Parliament anytime soon. This bill could not go through till now because Feminists in India opposed it vehemently saying that it is not stringent enough.

This bill does not take into account of possibility of domestic violence (physical or mental) against men by women. Moreover, it is obvious that there wont be any investigations when the woman accuses an NRI (Newly Rich Indian) man of indulging in Domestic Violence. Then the prey will be shared between Feminists sitting in guise of Counsellors, police and lawyers.

http://timesofindia.indiatimes.com/arti ... 956753.cms

......

To replace the lapsed Domestic Violence Bill 2002, the UPA government is working on a new one, which may be finalised soon. Apart from the usual penalties, a jail term and monetary fines, the draft Bill gives the court powers to drive an abusive husband out of the house he shares with his wife. The court will also be given powers to stop the abuser from accessing bank accounts, lockers or assets he may hold with his wife.

.......

So, a few more tips.

1) Do not keep much money in joint accounts.

2) If you sense any problems, do not make wife coapplicant in Home Loans even though the savvy bank fellow trys to convince you. Make your parents the coapplicants.

3) Of course, one can take help of yahoogroups like misusedowryact and nridivorce.

Bitterness of wives leads to abuse of India's anti-dowry laws

Women's rights groups in India are concerned that vendettas by some estranged wives could bring India's vital and hard-won anti-dowry laws into disrepute

THE OBSERVER , NEW DELHI

Monday, Jul 07, 2003,Page 9

Advertising The entire Sharma family is stuck inside New Delhi's Tihar Jail -- from the grandparents down to the youngest child, aged three. This is not due to some rampant criminal gene but because a daughter-in-law has filed charges against them alleging harassment to extract dowry payments.

http://free.freespeech.org/manushi/110/vimochana.html

Vimochana is Bangalore's No. 1 Womam Organisation.

Following is a part of the interview published in India's no.1 Women rights journal Manushi.

Q. How do you cope with such sordid domestic melodramas?

We provide help out of our conviction that there is a genuine need for such help. Otherwise the police, the lawyers and the courts will harass and extract money under the pretext of securing them justice. The failure of the existing machinery for redressal is too apparent to us to ignore the plight of victims of domestic violence.

There are also cases where women are the offenders such as in a situation where a woman tries to steal or lure another woman’s husband. Our aim is to be free of any kind of gender bias. Otherwise, some women will have the impression that just because they are women they can use our organisation to further harass their victims. We have to work objectively to get the facts of the case.

Q. For instance?

Say, a man is having an extramarital affair and his wife tells us to file a false case of dowry harassment against the husband to get even with him. Such cases are common among middle and upper middle class people. They make pathetic spectacles of themselves. Of course, there is a large number of cases of spouses cheating on each other even among the poorer sections of society, but somehow, they don’t turn as vindictive towards each other and display better sense by being more willing to reconcile and to tolerate each other’s indiscretions if they don’t get completely out of hand.

As they live on the margins of survival, their bonds are strengthened by their daily struggle. Even if they cannot provide adequate care for each other they remain concerned. It’s quite the opposite for the moneyed class. In the upper-middle class, money becomes the bone of contention in a troubled marriage. Most shocking is the behaviour of couples concerning their children who they think will be content to ignore parental lack of love and concern provided they are given all the comforts money can buy. We have seen mothers refuse responsibility to look after their children unless they are adequately compensated. We tell such people to go and hire legal aid to settle accounts with each other, instead of wasting our time.

Q You mean mothers too neglect children and use them as a tool for bargaining?

Yes. There are couples with plum jobs in multinational companies earning hefty salaries who, on separation, will treat responsibility for their children as a liability. These are very fickle human relationships which have been sustained until then under the veneer of superficiality and with an eye on each other’s bank balances.

Q. Have you encountered marriages with just a single problem—maladjustment, where there is no abuse of the sort you described earlier? Especially maladjustment on the woman’s part, where she can’t stand her in-laws, or desires a different lifestyle, for example. Do they resort to the misuse of anti-cruelty or anti-dowry laws as we have experienced in Delhi?

Yes, there have been cases of that sort as well. For example, we had a case where this woman knew her husband was seeing other women but she kept quiet to protect the family’s reputation. When she could not bear it any longer, she went to the police who told her to press dowry harassment charges against him. Her lawyer also advised her to do this and put it in her petition.

When we get such cases, our investigations often reveal that there is no evidence for such charges. Many a time the situation is actually the reverse, for example, cases where the woman has all the control over the family finances and the man has been forced to obey her dictates. Such cases don’t stand up during the evidence stage.

Q. But the police sometimes arrest the husband even in a false case, make threats of arresting other members of the family in the hope of getting bribes.

We know the police encourage such cases as they are looking for ways to extract bribes. So we try to avoid the police and the courts as far as possible. Only when we need an injunction order or maintenance, a visit to the police station or the courts is a must. Otherwise, we tell the couples coming to us to sort out their problems between themselves, that we will assist and advise only if their aim is to act honestly. We tell them resolve the issues and avoid needless mudslinging.

Q. Whereas lawyers will insist on telling lies...

They will even traumatise the children by making them witnesses. So we have to assure the couples of our commitment to help them out of their trouble and emphasise our availability when-ever they need to discuss their problems. It’s in the lawyer’s interest to let the case drag on in court as it increases his opportunities to charge higher fees. So, people cooperate with us except when they are blinded by their egos and cannot look beyond their craving for revenge, the attitude that, _I want to teach her a lesson.’

Q. Isn’t it the other way round too with "I want to teach him a lesson"?

Oh, women can be equally vicious. When the estranged couple has the money and resources, they don’t mind using it to play a power game, or more egotistically, to prove who can last longer in a dispute.

However, when the woman is clear in her mind that she does not want to live with the man and files for divorce, she tries to take away all her belongings. Otherwise, the man may report the matter to the police who in turn will immediately confiscate the woman’s belongings for as long as the case lasts in the court. A woman on a salaried job does not have the financial resources to start an independent life from scratch.

INDIAN MEN KILLING THEMSELVES HEAVILY! MY GOD

by Protect Indian Men » Wed Jan 26, 2005 4:12 am

The only people start concentration on reading this topic, when they themselves ar at danger....when their parents are targeted..as usually happening throughout india now.....

 http://www.geocities.com/illangoj/

ONE NEED NOT HAVE TO TAKE DOWRY TO FALL INTO 498A CASE, JUST A COMPLAINT IS SUFFICIENT IN >90% CASES TO GET ARRESTED AND BE IN JAIL. There are numerous cases where Parents getting jailed, where Wife stayed only few days (NOT MONTHS) with in-laws in several years(>4yrs..) of marriage.

This is a VERY BIAS law for marriages, clearly attacking Human Rights, fundamental rights-art.14(Right to equality). Deadliest one perhaps attacking the appropriate Societal Development of India and also stands powerful cause for population growth (blackmailed-living together) is IPC-Section 498A(COMMONLY CALLED ANTI-DOWRY LAW / Dowry Law).

This section has become EPIDEMIC of mis-usage in INDIA NOW. With Current Indian laws and system, Getting into Indian marriage is ‘ABHIMANYU's PADMAVUYA’. One gets into BIG TRAP, I repeat VERY BIG TRAP, if spouse is BAD in NATURE. Today, there is hardly a divorce, which happens without 498A case being filed on in-laws/husband.

The only ways to escape is either not marrying an Indian girl or prove innocence in the court, for which court case easily goes more than 2 yrs., as per current statistics. Citing a rule that the service of an employee who remained in police custody for more than 24 hours would be terminated.

Marital woes for men

DEBABRATA MOHANTY

Bhubaneswar, Jan. 10: Men in Orissa are coming out with tales of marital problems.
Figures available with the State Commission for Women (SCW), which started registering the problems of husbands four years ago, reveal that an ever-increasing number of husbands are at the receiving end of marital discord.

From 75 complaints in 2001, the number went up to 187 in 2004. In the past four years, SCW has received 546 complaints with men accusing their wives of harassment. From homeguards to social activists — the harried husbands belong to various sections of society.

“It’s true that several husbands are coming to us with their marital woes. But all that we can do right now is try and settle their problems amicably,” said Namita Panda, chairperson of SCW.

However, the commission has managed to settle only 70 cases till date, showing that amicable solutions are easier suggested than achieved.

Three years after Bikash Panda of Khurda got married, his wife Anita allegedly put pressure on him to shift to Bhubaneswar in 2003, which he was not willing to do since he had to look after his mother and sister at home.

Anita then went back to her paternal home in Balasore and sent a telegram threatening to file a dowry harassment case against Panda if he did not give in to her demands. Though Anita had not filed an FIR against him, Panda did not want to take a chance and moved the commission on October 14 last year. Anita was not available for comment. The SCW is yet to hear the case.

The commission agrees that there are times when women “jump the gun” in simple cases of marital discord. “After marriage, some women force their husbands to stay away from their parents. When the husbands protest, the girls run away and file complaints,” Panda said.

However, the commission feels that not all complaints are genuine. As Section 498 (A) of the Indian Penal Code makes it mandatory for the police to book the husband and his parents and other relatives/friends for a period of up to 48 hours, some men might move the commission to stall their impending arrest.

Indian married men still suffers!!

by victimized husband » Wed Feb 02, 2005 7:47 am

Many Indian men who immigrate to the United States would never think to be concerned over whether a "slim, fair" bride advertised in the Times of India or on a marriage Web site might try to extort money or visas out of him.

Deepak is a 28-year-old computational engineer in the East Bay who has spent his life savings battling 498A legal woes.

"I see these guys at the airport on their way to India, and I think, 'They look like poultry going to be slaughtered,'" he says with a melancholy laugh.

Tsering is a staff reporter for India West, a San Leandro, Calif.-based news weekly. The names of the men who were allegedly victimized have been changed for their protection.

=================

I know, as India is going back to stoneAge, in terms of corruption and society. It is highly difficult to amend or repeal this section 498A as long as corruption is wide spread and officials and organizations make good money out of it. My opinion, The best alternative is not marrying an indian girl at all for not having any risks in marriage life.

Its a shame of Indian Govt. that it has got such incompetent fellows to create and implement laws. There has to be some checks and balances in every law. There has to be some mechanism to punish (at least put a fine) on people who put false cases.

One guy's pregnant sister(who was in her parental home for delivery) was arrested after her sister-in-law put a false case.

I do not know what these Feminist Bitches really want.

Had they been arresting only the guy, then it would have been somewhat OK. But what about arresting elderly parents and sisters without any evidence being given. In a particular state of India, a woman was raped after her sister-in-law died in mysterious circumstances. Police arrested the raped girl in a dowry death case next day.

The agencies whose names resemble like the names of international beggers (with words give, aid ) etc., put big banners against "No dowry Pledge". Will they do anything for a guy and his unfortunate family who has signed no dowry pledge and gives proof that he has in fact given hugh money to his wife ? They will say, there are exceptions but we should look at bigger issue (in short they will say get lost). Indian Beggers go international. even when Govt. is refusing aid.

http://www.geocities.com/gorky_maksim/

How often an educated(employed) woman in India, marry an unemployed/uneducated guy ? Why the hell a woman has to marry up and not marry down when she has financial security ?

Still, many principled guys do not take dowry, share marriage expenses and buy property in females name only to be put in a false dowry case for further extortion.

Those people who demand hugh dowries for their sons are also the same kind of people who use their daughters to make money.

I only want Divorce from my in-laws.

I wonder why in India, there is no law for a variety of Divorces (divorce from in-laws or divorce from parents or divorce from children etc. ).

Men fought battles for Woman! Now Women fight Women in India

by Feminists harming Women » Fri Feb 04, 2005 2:26 pm

It is not a shallow fact in pondering whether feminists are really harming Women? If you get into the bottom of the Ocean of Women, one would see it very clearly.

According to Statistics, Divorce rate from 1999 to 2005 increased by multiple times... what is the reason behind it?

misusing 498A sction, which is placed by the force of feminists about 2 decades back and everyone came to know about this law now...as urban are well educated and know the loopholes in the laws..

at the same time, once this 498A is filed, men do not reconcile as his whole family went inside the Jail that too for misusing reasons and not really dowry victim...

Otherway, feminists harm women indirectly, I believe..reasonable perception...

Okai so you are angry at your wife calling you a pot belly. Why dont you work out and shape up if all thats what she wants?

Then you can leave that STUPID org and get Normal.

I did not join that "stupid" organisation because of what my wife or in-laws did to me.

I was shocked to find out how people's minds are controlled by propaganda in this world. How easily we accept any notions fed via media, newspapers, history books, stories. At least internet is a bit free.

"If you tell a lie 100 times, it becomes truth".- Joshep Goebbles, Nazi Propaganda Minister.

Please remember that Goebbles never told lies. He told half truths which are even more dangerous.

I know, that we all are trained to have a kind of structured thinking. When we get something into our brains which does not fit with our existing notions, thinking habits, then we cry foul (always without even taking a look at facts).

"Do you feel, this kind of behaviour is healthy or do you feel this is normal behaviour ?"If yes, then I do not mind remaining abnormal inside that Stupid organisation.

This entire exercise by me is just an experiment. I must thank you all for helping me conduct this experiment on Structured Thinking.
